Public Commentary Following Recent Constitutional Proceedings

1. As Registrar of the High Court of Solomon Islands and the Court of Appeal, I note the considerable public interest that has arisen following the delivery of judgment in recent constitutional proceedings involving senior office holders of the State.
2. In light of the volume and tenor of commentary circulating, particularly on social media platforms, I consider it appropriate to make the following observations.

Members of the Legal Profession

3. Members of the legal profession occupy a position of particular responsibility within the administration of justice. As officers of the Court, their duties extend beyond the representation of clients and include a broader obligation to uphold the integrity of the judicial process.
4. That obligation requires the exercise of restraint, courtesy, and measured judgment in all public commentary, including on social media. Public statements by legal practitioners carry weight; they are not merely private expressions, but reflections upon the profession and, in turn, the justice system.
5. I therefore remind members of the Bar of the importance of maintaining the highest standards of professional conduct in their public discourse. Commentary which may undermine public confidence in the Court, diminish respect for its processes, or give rise to perceptions of partiality or impropriety is inconsistent with those obligations.
6. The administration of justice is sustained not by any single institution alone, but by the conduct of all who participate in it. Members of the profession, by reason of their role and standing, bear a particular responsibility to ensure that public discourse reflects the values of independence, respect, and fidelity to the rule of law.

The General Public

7. I also acknowledge the strong public interest in matters of constitutional importance, particularly those involving elected representatives and questions of governance.
8. Such interest is both natural and legitimate in a democratic society. However, it is important that public engagement with judicial proceedings reflects an understanding of the role of the Court and the processes by which legal disputes are determined.
9. Court proceedings are governed by established legal principles and procedures designed to ensure fairness, impartiality, and the orderly resolution of disputes. These processes must be allowed to operate without undue pressure, mischaracterisation, or premature judgment.
10. It is worth remembering that any member of the public appearing before the Court would expect their matter to be approached with fairness and without public judgment. That same standard applies to all parties. The law affords each person the right to have their case determined properly, including the right to pursue further processes such as appeal. The exercise of those rights should not give rise to criticism or negative inference.
11. Public confidence in the administration of justice is not the preserve of any single institution. It is maintained through the collective regard shown to the Court, its processes, and those who appear before it. I therefore encourage all members of the public to approach commentary on judicial matters with restraint, courtesy, and respect.

Conclusion

12. The strength of the justice system rests not only upon the decisions of the Court, but upon the confidence reposed in it by the community it serves. That confidence is reinforced where all who engage with the justice system, professionally or otherwise, do so with care, discipline, and respect for its constitutional role.
13. The High Court will continue to discharge its functions independently, impartially, and in accordance with the law.
